Terms & Conditions

A few things worth knowing

Welcome to Headcase Hats.

These Terms & Conditions explain the basics of purchasing from Headcase Hats and using our website. By placing an order or using our website, you agree to these Terms.

We've tried to keep the legalese to a minimum. Hats are complicated enough.

1. About Headcase Hats

Headcase Hats is an Australian millinery business creating one-of-a-kind hats and headpieces.

Our pieces are individually designed and handmade, which means there may be small variations in colour, texture, finish and construction between pieces. These variations are part of what makes handmade millinery special.

Unless otherwise stated, each Headcase is a unique piece and availability is limited to one.

2. Our products

We take care to make sure product descriptions, photographs, colours, dimensions and other information on the website are as accurate as possible.

Because hats are handmade and photographed under different lighting and on different screens, colours may appear slightly different from what you see on your device.

Some pieces may have natural variations in materials such as feathers, felt, straw, silk, leather or other trims. These are characteristics of the materials rather than imperfections.

If you have any questions about a piece before purchasing, please get in touch. We're happy to provide additional information or photographs where possible.

3. Prices

All prices on the website are shown in Australian dollars (AUD) and include GST where applicable.

We reserve the right to change prices from time to time. The price shown at the time you place your order is the price that applies to your purchase.

We may occasionally offer sales, promotions or discounts. Unless otherwise stated, promotional offers cannot be combined.

4. Payments

Online payments are processed securely through Stripe.

By submitting an order, you confirm that you are authorised to use the payment method provided.

Your order will only be confirmed once payment has been successfully received.

5. Placing an order

When you place an order through the website, you are making an offer to purchase the selected Headcase.

We'll send you an order confirmation once your order has been received.

Because our pieces are often one-of-a-kind, we take care to keep product availability up to date. In the unlikely event that a piece becomes unavailable after you place an order, we'll contact you as soon as possible and provide an appropriate resolution.

6. Customisation & bespoke pieces

Some Headcase pieces can be modified or customised on request.

Depending on the piece, this may include adjustments to fit, colour, trims or other details.

Any requested modification will be discussed with you before work begins, including any additional costs and expected timeframe.

For bespoke pieces created specifically for you, we'll work with you through the design and consultation process to agree on the key details before making your piece.

Because bespoke millinery is created specifically for you, please make sure you're happy with the agreed design before production begins.

Nothing in this section limits your rights under the Australian Consumer Law.

7. Fit & consultations

We want your Headcase to feel as good as it looks.

Where possible, we can make adjustments to achieve the best fit for you. If you're unsure about sizing or how a particular piece will sit, we encourage you to contact us before purchasing or book a private consult.

If you purchase a piece online and require advice about fit, please contact us as soon as possible.

8. Shipping & delivery

We currently ship within Australia.

International shipping may be available by special request. Please contact us before purchasing if you'd like a Headcase sent overseas.

Delivery timeframes will vary depending on the piece, your location and the shipping service selected. Any estimated delivery timeframe provided by us is an estimate rather than a guarantee.

Once your order has been handed to the delivery provider, delivery is subject to their processes and timeframes.

If your order is delayed, lost or arrives damaged, please contact us and we'll work with you to resolve the issue.

9. Returns, refunds & consumer guarantees

Our Returns & Care policy explains our approach to change-of-mind returns and caring for your Headcase.

Because our pieces are often one-of-a-kind and made in small quantities, we do not offer returns or exchanges simply because you have changed your mind.

However, nothing in these Terms or our Returns & Care policy excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

Our products come with consumer guarantees that cannot be excluded under Australian law.

If a Headcase has a problem that means it does not meet an applicable consumer guarantee, we will provide the remedy required by law.

Consumer guarantees do not generally apply where a problem has been caused by misuse, accidental damage or use of the product in a way it was not designed for.

For more information, please see our Returns & Care page.

10. Looking after your Headcase

Our hats are made to be worn — but they do appreciate a little care.

Please follow the care recommendations provided with your piece and take care to protect it from rain, moisture, excessive heat, crushing and unsuitable storage.

Damage caused by accidents, misuse, improper handling, unsuitable storage or exposure to conditions that may damage the piece is not considered a manufacturing fault.

Where possible, we may be able to offer repair or restoration services. Please contact us if your Headcase needs some attention.

11. Intellectual property

All content on this website, including photographs, product images, logos, branding, written content, designs and other creative material, belongs to Headcase Hats or is used with permission.

You may view and use the website for your personal, non-commercial purposes.

You may not reproduce, copy, modify, distribute or use our content or designs commercially without our written permission.

Please don't borrow our hats either. Unless you ask nicely.

13. Our liability

To the extent permitted by law, Headcase Hats is not responsible for loss or damage arising from your use of the website where that loss or damage is not reasonably foreseeable or is outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any rights, remedies, guarantees or obligations that cannot legally be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.

14. Changes to these Terms

We may update these Terms from time to time as our business, website or services change.

The latest version will always be published on this page.

Your continued use of the website after an updated version is published constitutes acceptance of the updated Terms for future use of the website.

15. Governing law

These Terms are governed by the laws of Victoria, Australia.

Any disputes will be dealt with in accordance with the applicable laws and courts of Victoria, subject to any rights you may have under Australian consumer law.
